Obligations of the Renter

The Renter accepts the provisions of this rental agreement and confirms receipt of a copy.

The driver must be at least 21 years old and have held a valid driver’s license for at least one year. The Renter must comply with Mauritian laws and regulations. The vehicle remains under the Renter’s responsibility until Givesha Tours registers it as returned during official business hours.

 

Vehicle Return Requirements

  • With all original items (tires, tools, documents, maps, etc.) in the same condition as received, allowing for normal wear and tear. Missing or damaged items will be charged to the Renter’s credit card.
  • At the agreed time, or earlier if requested by Givesha Tours.
  • At the same Givesha Tours rental office, unless otherwise agreed. Additional charges apply for alternate drop-off locations.
  • With a full tank of fuel. Missing fuel will be charged at the local rate plus a 10% service fee.

 

Fuel & Costs During Rental

The Renter is responsible for all fuel and driving-related expenses during the rental period. The rental period only ends once the vehicle is officially checked in during business hours.

 

Late Returns

  • Repossession of the vehicle by Givesha Tours or police.
  • A full-day charge if returned more than one hour late.
  • Additional daily charges for every further delayed day.

 

Authorized Drivers Only

Only drivers listed in the rental agreement who meet all age and licensing requirements may drive the vehicle. Insurance is voided if driven by an unauthorized person, and the Renter assumes full liability for any damage.

 

Liability for Damages

The Renter is objectively liable for:

  • Damage not covered by insurance
  • Theft or loss of the vehicle
  • Damage to passengers or third parties not covered by insurance

 

Prohibited Actions (Driver Liability Applies)

  • Driving off-road
  • Driving in rivers, streams, or watercourses
  • Intentional or grossly negligent behavior
  • Driving under the influence of intoxicants
  • Any activity violating Mauritian law or this agreement

 

Prohibited Uses

  • Off-road use, beaches, paths, or areas only accessible at low tide
  • Driving under the influence
  • Driving across rivers or through water

 

In Case of an Accident

  • Immediately notify the police and Givesha Tours
  • Remain at the scene until a report is filed
  • File a damage report immediately

Failure to report damage within 12 hours makes the Renter fully liable, even if CDW was purchased.

 

Odometer and Distance

  • Distance is recorded via the odometer.
  • Malfunction must be reported immediately.
  • Givesha Tours reserves the right to estimate distance driven if the odometer fails.

 

Additional Responsibilities

  • A deposit is required at rental start.
  • Unauthorized repairs or changes are prohibited.
  • The Renter is responsible for fines, tickets, and related charges.
  • The vehicle may not be sub-leased, lent, or used for paid transport.
  • The Renter covers vehicle recovery costs due to breakdown or accident.

 

Obligations of Givesha Tours

  • The vehicle will be roadworthy and legally compliant.
  • It will be provided with a full tank of fuel.
  • Givesha Tours will strive to deliver the vehicle on time. If delivery is over 8 hours late, that day’s rental fee is waived.
  • In case of mechanical failure not caused by the Renter, a replacement vehicle or repair will be provided as soon as possible.
  • No compensation is offered for accommodation or related costs.
  • Givesha Tours will inform renters, especially foreigners, of Mauritian traffic laws, signs, and off-road restrictions.
  • Givesha Tours will maintain valid liability insurance at all times.
  • Givesha Tours is not liable for lost or damaged personal items in the vehicle.

 

Insurance & Collision Damage Waiver (CDW)

  • The rental includes mandatory liability and accident insurance.
  • The Renter may still be liable for the full vehicle value, depending on the incident.
  • CDW reduces liability, but the Renter must always pay a minimum amount for damage. This amount is listed in the current Givesha Tours pricelist.
  • Each CDW claim covers one incident only.

 

CDW Does Not Cover

  • Intentional or grossly negligent damage
  • Driving under the influence
  • Damage from races or test-driving
  • Damage from civil unrest or war
  • Damage caused by animals
  • Burns to interior (seats, mats)
  • Damage to tires, suspension, glass, batteries, radio equipment
  • Theft of vehicle parts
  • Damage from rough terrain
  • Driving in restricted or non-road areas
  • Damage from sand, gravel, ash, or volcanic materials
  • Theft of the vehicle
  • Water damage

 

Theft Protection (TP)

An optional TP fee can reduce liability if the vehicle is stolen. A minimum charge still applies in all theft cases.

 

General Provisions

  • No insurance or CDW covers chassis damage or damage from driving in rivers or lakes.
  • Givesha Tours may repossess the vehicle without notice if it’s used illegally, abandoned, or against contract terms.
  • Rental fees still apply even if the vehicle is repossessed, unless re-rented to another party.
  • Givesha Tours may charge the Renter’s credit card for rental fees, damages, and lost rental income.
  • This right lasts up to 6 months after return.

By signing the agreement, the Renter authorizes these charges.

The Renter confirms the vehicle and all accessories were received in good condition.

The rental agreement must remain in the vehicle during the rental.

Any changes to the contract must be in writing and signed by both parties.

This agreement is governed by Mauritian law, and all disputes must be brought before the Courts of Mauritius at the designated legal venue of Givesha Tours.

 

Acceptable Evidence for Damage or Theft

The following documents will be accepted as valid proof:

  • Invoice from an approved garage
  • Photos of the damage or theft
  • Signed rental agreement
  • Damage report by a Givesha Tours employee
  • Check-in report (if returned during opening hours)
  • Completed motor vehicle claim form
